1. Agreement to these Terms
These Terms of Service ("Terms") are a binding agreement between you and Unicorn and Woodsman LLC, doing business as FutureMakers and ("FutureMakers," "we," "us," or "our"). They govern your access to and use of:
- our website at kidsmakethingsbetter.com,
- our online store at shop.futuremakers.fun, and
- our related products, digital content, accounts, and services (together, the "Services").
By accessing the Services, creating an account, or placing an order, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
2. Who we are
FutureMakers designs hands-on STEM building kits ("Sparks") and accompanying digital instructional materials ("Educator Guides") for educators, schools, camps, and families. Our principal address is 1700 West 41st Street, Baltimore, MD 21211, US.
3. Eligibility and accounts
- Purchasers must be 18 or older. Sparks are sold to adults — educators, school and program administrators, and parents/guardians — for use with children under adult supervision. The Services are not directed to children, and children may not create accounts or make purchases.
- Some features (educator profiles, "My Sparks," and gated Educator Guides) require an account. You are responsible for the accuracy of your account information and for keeping your login credentials secure. You are responsible for all activity under your account.
- We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being misused.
4. Sparks products: physical kits and digital guides
Each Spark may include (a) physical materials and components and (b) one or more digital Educator Guides made available through your account.
License to digital content. Subject to these Terms and your payment, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Educator Guides for your own instructional, classroom, camp, or family use. You may print and reproduce guide materials only as reasonably needed to run sessions with your own learners.
You may not, without our prior written permission:
- resell, sublicense, rent, or redistribute the Educator Guides or other digital content;
- post the digital content publicly or share account access outside your organization;
- remove proprietary notices, or use the content to create a competing product.
This license ends if you violate these Terms.
5. Orders, pricing, quotes, and payment
- Pricing. Prices, product descriptions, and availability may change without notice and may contain errors; we may correct errors and cancel affected orders even after an order is placed.
- Orders. Your order is an offer to buy. We may accept or decline it, in whole or in part, including for suspected fraud, pricing errors, or stock limits.
- Quotes. Quotes provided through our quote request flow are estimates valid for the period stated on the quote and are subject to confirmation at the time of order.
- Tax-exempt purchases. Eligible institutions may purchase tax-exempt by following the process at kidsmakethingsbetter.com/tax-exempt-purchases. You are responsible for the validity of any exemption you claim.
- Payment. Online store payments are processed by our third-party payment providers (including Shopify). By submitting payment information you represent that you are authorized to use the payment method.
6. Shipping, returns, and refunds
Shipping, delivery, returns, and refunds for physical Sparks are governed by the policies posted in our online store at the time of purchase. Digital Educator Guides are generally non-refundable once access has been granted, except as required by law.
7. Product safety, age-appropriateness, and adult supervision
Sparks are hands-on building activities. Depending on the kit, they may include small parts, sharp or pointed tools, adhesives, batteries, motors, electrical components, moving or wind-up mechanisms, and craft materials. These carry inherent risks — including choking, cutting, pinching, burns, and electrical hazards — if mishandled or used without supervision.
Adult supervision is required. Sparks are sold to adults for use with children under the continuous, active supervision of a responsible adult. Do not leave children unattended with kit components or tools.
Age-appropriateness. You are responsible for determining whether a given Spark is suitable for the age, maturity, and ability of each learner. Unless a product expressly states otherwise, Sparks are not intended for children under 4 due to small parts that pose a choking hazard. Keep small parts, batteries, and packaging materials away from infants and young children. Sparks are not to be used unattended by an adult by any child under the age of 7.
Before and during each session, you agree to:
- read and follow all instructions, warnings, and safety guidance included with the product or in the Educator Guide;
- inspect components for damage and remove any that are broken, sharp, or worn;
- ensure the activity space, tools, and materials are appropriate for the group, and that learners use any recommended protective measures;
- supervise the use of tools (such as scissors, hand tools, or hot glue) and of any electrical, motorized, or battery-powered components; and
- account for any known allergies or sensitivities to the materials used in the kit.
Batteries and electronics. Some Sparks include batteries. Follow all polarity and handling instructions, do not short-circuit batteries or attempt to charge non-rechargeable cells. Dispose of batteries and electronics in accordance with local regulations.
Assumption of risk. Hands-on building involves inherent risks that cannot be fully eliminated. To the fullest extent permitted by law, you accept responsibility for supervising these activities and for any injury, loss, or damage arising from a failure to follow the safety guidance above or to provide adequate adult supervision.
8. Intellectual property
The Services and all content we provide — including Sparks designs, Educator Guides, text, graphics, logos, photos, and software — are owned by FutureMakers or our licensors and are protected by intellectual property laws. Except for the limited license in Section 4, we grant you no rights in our content or trademarks ("FutureMakers," "Sparks," "Kids Make Things Better," and related marks). We have registered our trademark and will defend it aggressively.
9. Acceptable use
You agree not to:
- use the Services unlawfully or in violation of these Terms;
- copy, scrape, or harvest content except as expressly permitted;
- interfere with, probe, or attempt to gain unauthorized access to the Services or other users' accounts;
- upload malicious code or misuse the Services in a way that could disrupt them.
10. User submissions
If you submit content to us (for example, reviews, photos, or quote requests), you grant us a non-exclusive, worldwide, royalty-free license to use it to operate and promote the Services. You are responsible for ensuring you have the rights to share what you submit and that it does not violate anyone's rights or any law. Do not submit photos identifying children without the consent of their parent or guardian.
11. Third-party services
The Services rely on third parties (including Shopify for the store, and providers for accounts, hosting, and email). Your use of those features may also be subject to the third parties' terms. We are not responsible for third-party services we do not control.
12. Disclaimers
THE SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. We do not warrant that the Services will be uninterrupted, error-free, or secure.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FUTUREMAKERS AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
14. Indemnification
You agree to indemnify and hold FutureMakers harmless from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Services or products, your violation of these Terms, or your violation of any law or third-party right.
15. Governing law and disputes
These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Maryland have exclusive jurisdiction over any dispute that is not otherwise resolved, and you consent to venue there.
16. Dispute resolution; binding arbitration; class-action waiver
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO SUE IN COURT AND TO HAVE A JURY TRIAL.
Informal resolution first. Before starting an arbitration, you agree to contact us at matt@kidsmakethingsbetter.com and give us 30 days to try to resolve the dispute informally. Most concerns can be resolved this way.
Binding arbitration. If we cannot resolve a dispute informally, you and FutureMakers agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or our products (except as stated below) will be resolved by final and binding arbitration, rather than in court. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect. The arbitration may be conducted in Maryland or, at your election, by telephone, video, or written submissions. The arbitrator's award may be entered as a judgment in any court of competent jurisdiction.
Class-action waiver. You and FutureMakers agree to bring claims against each other only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of representative or class proceeding.
Exceptions. Either party may (a) bring an individual claim in small-claims court if it qualifies, and (b) seek injunctive or other equitable relief in court to protect its intellectual property or to stop unauthorized access to or misuse of the Services.
Your right to opt out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing matt@kidsmakethingsbetter.com with your name and a clear statement that you opt out of arbitration. If you opt out, the rest of these Terms — including Section 15 (Governing law) — still applies.
17. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above shows the latest revision. Material changes take effect when posted; your continued use of the Services after changes means you accept the updated Terms.
18. Severability and other terms
- Severability. If any part of these Terms is found to be invalid or unenforceable, that part will be limited or removed to the minimum extent necessary, and the rest of these Terms will remain in full force and effect.
- No waiver. Our failure to enforce any part of these Terms is not a waiver of our right to enforce it later.
- Assignment. You may not assign or transfer these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of our assets.
- Entire agreement. These Terms, together with our Privacy Policy and the store policies referenced in them, are the entire agreement between you and FutureMakers regarding the Services and supersede any prior agreements.
